1.GENERAL
1.1. These rates of dues levied on vessels in the commercial sea ports of the Russian Federation are set by the Ministry of Economy of the Russian Federation at the request of the Ministry of Transport of the Russian Federation.
The controlled port dues include:
— Tonnage dues
— Light dues
— Berth dues
— Anchorage dues
— Environment dues
— Pilotage dues
— Navigation dues
The port dues are levied on the Russian and foreign vessels and floating objects specified in Table 1 in the commercial sea ports of the Russian Federation, regardless of their organizational and legal forms and ownership.
1.2. The rates of dues are set for the Russian coastal trade and foreign going vessels and foreign vessels.
1.3. The rates of dues for the coastal trade vessels are set in roubles, are basic rates and subject to indexation in accordance with the established procedure.
1.4. For the Russian foreign-going vessels and foreign vessels the rates of dues are set in US dollars. However, due to changes in Russian Tax legislation from 01.01.2005 Novorossiysk Commercial Sea Port, towage company OAO Fleet NCSP, and auxiliary services providing companies (watchmen services, repairshops, etc) collect payment for their services in RUSSIAN ROUBLES. The Russian vessels shall make payments in roubles at the exchange rate of the Central Bank of Russia as of the day of the vessel's departure.
1.5. The currency in which the dues levied on the vessels flying flags of the CIS countries are paid is stipulated by the relevant interstate agreements.
1.6. The state identity of the vessel and the status granted thereto in collecting the dues is determined by the flag she flies regardless of who own or operates the vessel.
1.7. A voyage for Russian vessels in which the vessel arrived in a Russian port was performing cargo handling operations in a foreign port or is bound for a foreign port for this purpose is considered to be a foreign traffic voyage.
In the voyages which are not covered by this definition dues are paid id the coastal trade rates.
Dues are charged for the voyage in which the vessel entered the port/ The tonnage, canal and pilotage dues levied on the vessel leaving the port are charged for the voyage in which the vessel leaves the port.
Dues levied on the vessel delivered in the port in ballast are charged for the voyage which it has been delivered for. Dues levied on the vessel leaving the port in ballast are charged for the voyage in which it entered the port.
1.8. The vessel's conditional volume in cubic meters is calculated by multiplying the values of overall length, maximum breadth and overall depth specified in the vessel's documents.
For the vessels which carry cargo on the upper deck or which have two or mere decks the overall depth used in calculations shall constitute at least one-half the vessel's maximum breadth.
The conditional volume of the tug-and-barge assemblies, convoys and other composite floating objects used for calculating all types of dues, except the environment dues, is determined as an aggregate volume of individual components.
1.9. Lighter-aboard ships performing lighter handling operations on the outer or inner roads are charged for the aggregate volume of the lighters discharged on arrival in and loaded prior to departure from the port.
1.10. For calculating all types of dues the conventional volume of Ro-Ro, Lo-Ro, Ro-Flo, OBO and container carrying vessels is multiplied by 0,7 factor.
1.11. The type and trade of the vessel are determined by the vessel's documents.
1.12. The rate surcharges and rebates are applicable to the basic rate.
Whenever more than one rebate is granted only the largest one shall apply.
1.13. Training vessels of various types are exempted from all types of dues.
1.14. Port dues shall be paid by the vessel prior to the departure from the port.
In accordance with the Russian Merchant Shipping Code the Harbour Master has the right to refuse a permission to the vessel to leave the port if the prescribed dues have not been paid.
Transit vessels have the obligation to guarantee the payment of the port dues by a radiotelegraph message. In the absence of the guarantee of payment the Harbour Master has the right of refusing permission to the vessel to transit the port area.

* Port local craft and vessels owned by shiprepair yards, which make commercial international voyages, fall in group «A» or «V».
** Transit vessels are the vessels which pass through the harbour area without being moored to a berth, buoys, piles, without riding at anchor or without any other connection with the ground within the harbour area.
*** A call for refuge means a call in view of a threat presented to the safety of continuing sailing, to the life or health of the crew and passengers.
2. TONNAGE DUES
2.1. The rates of the tonnage dues are listed in Table 2. Vessels of groups "A", "B", "V", "G" and "Z" are charged per 1 m3 of the vessel's conditional volume separately for each inward and outward port passage.
Exempted from tonnage dues are vessels of groups "D", "E", "J" unless they perform cargo handling and passenger operations of commercial nature at the port.
2.2. For the vessels of groups "A" and "B" which load or discharge cargo at several Russian ports within one and the same voyage the tonnage dues are charged at full rates (100 per cent) at the first port of call and at half rates (50 per cent) at each subsequent port of call.
2.3. For the vessels of group "G", passenger vessels in the foreign traffic and ferries operating on the international routes opened in accordance with the established procedure the tonnage dues are charged at each port of call for the first inward and outward passage once in a calendar year. For the ferries in interport traffic which do not operate on the routes opened in accordance with the established procedure the tonnage dues are charged for each inward and outward passage.
2.4. A 20 per cent rebate is granted to the cargo vessels operating on the international routes opened in accordance with the established procedure.
The main indications of an international route opened up in accordance with the established procedure are:
— the prescribed compulsory and optional foreign and Russian ports of call;
— the vessels assigned for the operation on the route;
— the prescribed intervals between the calls made by the assigned vessels at the Russian ports;
— registration of the service by the Department of Sea Transport of the Ministry of Transport of Russian Federation at the request of the Port Authority (of the sea port).

3. LIGHT DUES
3.1. Rates of the light dues are listed in Table 3. For the vessels of groups "A", "B", "V", "E" and "Z" light dues are charged per 1 m3 of the conditional volume of the vessel for each inward passage or for transiting a port.
3.2. Exempted from the light dues are vessels calling for refuge to perform an emergency repair and the vessels of group "G". Vessels of groups "D" and "J" are exempted from the light dues unless they perform cargo handling and passenger operations of commercial nature at the port.

4. BERTH DUES
4.1. The rates of the berth dues are listed in Table 4. The berth dues arc collected from vessels staying alongside the berth. For the vessels of groups "A", "B" and "Z" berth dues are charged per 1 m3 of the conditional volume of the vessel for each day of the vessel's stay alongside the berth. The time of stay at a berth is rounded off upward to one-half of the day.
For the vessels of groups "V", "G", "D", "E" and "J" berth dues arc charged per 1 m3 of the conditional volume for each call.
4.2. A 50 per cent rebate is granted to the vessels lying alongside other vessels made fast to a berth or made fast bow or stern to a berth.
4.3. The vessels of group "E" (with the exception of vessels calling at a port for the customs or frontier formalities) are exempted from the berth dues. Vessels of groups "D" and "J" and vessels calling for refuge are exempted from the berth dues unless they perform cargo handling and passenger operations of commercial nature at the port.
4.4. For occupying berth or using berth after completion of cargo handling operations, for the reasons within the ship's or shipowner's (shipping company's) control, the berth dues are charged at the rate of RUR 11.8 per 1 meter of berth per 1 hour (vessel's LOA is used for calculation), starting from the moment of completion of the discharging/loading and lashing of the cargo. Using berth of less than one hour is to be charged as one hour.

5. ANCHORAGE DUES
The rates of the anchorage dues are listed in Table 5. The anchorage dues are charged per 1 m3 of the vessel's conventional volume and collected from vessels of all the groups for each hour of staying at anchor on the inner or outer roads over a period in excess of 12 hours. The charge for the first 12 hours of the vessel's stay is not collected. Time of staying at anchor for less than one hour is to be charged as one hour.

6. ENVIRONMENT DUES
6.1. The rates of the environment dues are listed in Table 6. The environment dues are charged per 1 m3 of the vessel's conditional volume and collected from the vessels of groups "A" (except non-powered vessels), B (except non-powered vessels), "V" (except passenger vessels), "G" (except passenger vessels) and "Z" per 1 m3 of the vessel's conditional volume or a self-propelled component of a composite floating object without any restrictions on all the kinds of presented wastes (except ballast water) during the entire period of the vessel's stay in port. The rates of dues include payment for all the operations connected with the reception of shipboard wastes (delivery and removal of floating facilities, provision of containers and other receptacles to collect garbage, transshipment operations, hose handling, etc).
With the aim of preserving the environment the vessel must hand over in the port collecting the environment dues all the wastes available on board for removal. Removal of the wastes is to be properly certified by the Port Authority (sea port).
6.2. A 50 per cent rebate is granted to the vessels which are equipped with environment protection facilities for the complete recovery of all kinds of wastes and pollutants and which are supplied with appropriate international certificates for the prevention of pollution of the sea by oil sewage and garbage (environmentally safe vessels).
6.3. Passenger and non-powered vessels are exempted from the environmental dues. Vessels of groups "D", "E" and "J" are exempted from the environmental dues unless they perform cargo handling and passenger operations of commercial nature at the port. Removal of wastes from the vessels exempted from the environmental dues is performed at the port, at the shipmaster's request, according to the rates properly approved by the port.
6.4. The environment dues are not collected at the ports where technical facilities for the removal of all kinds of shipboard wastes are not available. At the said ports removal of the wastes including ballast water is performed according to the rates properly approved by the port.

7. PILOTAGE DUES
7.1. The rates of the pilotage dues are listed in Table 7. The pilotage dues are charged per 1 m3 of the conditional volume of the vessel. The necessity of pilotage is determined by the Compulsory Port Regulations.
7.2. In case of harbour pilotage the pilotage dues are charged for each operation. In case of coastal pilotage the pilotage dues are charged for each pilotage mile. A pilotage distance of less than one mile is to be charged as one mile. A vessel with a conditional volume less than 5000 m3 should be charged as the one of 5000 m3.
The boundaries of the coastal and harbour pilotage are determined by the Compulsory Port Regulations.
7.3. The pilotage dues include the charge for transport facilities used by pilot to board and leave the vessel.
7.4. The vessels of group "D" (except sport craft and private yachts) are exempted from the pilotage dues unless they perform cargo handling and passenger operations of commercial nature at the port.
7.5. A 20 per cent rebate is granted to the cargo vessels operating on international routes opened in accordance with the established procedure and to the passenger vessels in coastal traffic.
7.6. For piloting the foreign and Russian sport craft and private yachts the pilotage dues are collected at the following rates:

7.7. For piloting vessels into or out of the dock, vessels with main engine out of operation, inoperative rudder-propeller system, special floating objects (drilling rigs, modules, docks, hotels etc.) the pilotage dues arc charged at the rates specified in Table 8 increased by 50 per cent.
7.8. The pilotage during the determination of compass deviation shall be paid for at the rates of harbour pilotage regardless of the area where the work is performed.
7.9. If several vessels are piloted simultaneously, each vessel should be charged for pilotage separately at full rate.
7.10. The dues are collected in accordance with the pilot receipt issued by the pilot, certified by the shipmaster or in accordance with the vessel's radiotelegraph confirmation.
7.11. The shipmaster who has provided incorrect data on the vessel's draft, length, breadth and cargo capacity is subject to the penalty at the double rate of the set pilotage dues, regardless of any general liability provided for by the law for the consequences which may arise as a result of incorrect data.
7.12. Cancellation of the request for pilotage is charged at a 100% rate payable for pilotage for which a pilot had been requested.

8. NAVIGATION DUES
8.1. The rates of the navigation dues are listed in Table 9. The navigation dues are charged per 1 m3 of the vessel's conditional volume at the ports equipped with shore-based radar vessels traffic management systems for each inward and outward passage or transiting the port.
8.2. Exempted from the navigation dues are auxiliary and survey vessels, vessels calling for refuge and for an emergency repair as well as the vessels of group "D" unless they perform cargo handling and passenger operations of commercial nature at the port.

9. FIRE GUARD SERVICE
The service of fire boat’s service during all the period of its stay at the wharf are remunerated at the rate of RUSSIAN ROUBLES 0,42 per cbm. for foreign flag vessel’s volume and RUR 0,336 per cbm for Russian flag vessel’s volume.
10. TUGBOATS HIRE FOR MOORING OPERATIONS
10.1 All vessels, except for the vessels of the group D,E,L,M are charged according to tariffs for the hire of all tugboats used for mooring, unmooring and shifting operations.
10.2 The number and capacity of tugboats necessary for mooring or unmooring is determined by Port Obligatory Regulations or is ascertained by Pilots Service in agreement with the Shipmaster.

11.MOORING CHARGE
11.1 All vessels are charged according to tariff for mooring, unmooring, dragging alongside a wharf or shifting from a wharf to another one.
11.2 Dragging a vessel alongside wharf at a distance e[ceding vessel’s length is charged as two operations, and at a less distance, as one operation.
11.3 Shifting a vessel from a wharf to another one is charged as two operations.

12. AGENCY FEE AND SUNDRY
12.1 Agency Fee for all the services rendered to Russian ocean-going vessels and foreign-flag vessels and their crews are to be paid in US Dollars before departure from the port.
12.2 Agency Fees will be based on a ship's CONDITIONAL VOLUME (in cubic meters) The volume of pusher-barge systems, convoys of vessels and other compound objects will be measured as the aggregate volume of all the components.
12.3 For a vessel carrying a cargo on the upper deck, or which has two or more decks, the Moulded Depth used for calculation is to be not less than a half of the vessel's Breadth Overall.
12.4 When the vessel is consigned to a third party and its owners entrust the Agent to look after their interests, the remuneration of 35 % of the relevant basic fee is payable to the Agent (Protecting Agency).
12.5 When upon completion of discharging the vessel is loading a cargo at the same port, a 25 % rebate is granted for the second operation.
12.6 A 25 % rebate is granted to a vessel when less than 25 % of its carrying capacity is used for loading or discharging a cargo at the same port (liner vessels excluded)
12.7 A 10 % and 25 % surcharges for loading or discharging raw sugar and grain in bulk respectively.
12.8 When the period of vessel's stay at the port exceeds 10 days a 15 % surcharge is assessed on the basic fee for each succeeding period of 5 days or part thereof.
12.9 When a vessel calling at the port for handling a cargo load or discharge over 10 tons of dangerous goods a 25 % surcharge is to be assessed on the basic Agency Fee.
12.10 The motor transport hire for ship's business, telegrams, telexes, postage and faxes expenses, Bank Charges, Pettiest, arranging shiprepair, arranging the attendance of surveyors of the Russian Register of Shipping, arranging fumigation of cargo, arranging of the medical assistance as well as for the interpreting service and translation of the documents, arranging repatriation of the crew members, visas, booking tickets and hotel accommodations, etc... Are chargeable according to local tariffs/mutual agreements or at actual costs.
12.11 When the Ship's Master or his crew request to arrange the motor transport and/or attendance of the agent for the personal disposal the charges are collected in cash according to local tariffs or at actual costs.

SUPERVISION
The services of supervision are remunerated at the flat rates of tariff (specified below).
Vessels calling at the port for repair, bunkering or supply are charged rate of USD 27.00 for 24 hours or part thereof for the services rendered.
When a supervisor’s (boarding agents) attendance is requested by the Master of the vessel staying in roads (when no cargo is handled), or such attendance is required prior to the vessels’ receiving a free practique, or the services were rendered after vessel’s departure, the remuneration is to be collected at the relevant rates provided for 24 hrs.

Other charges:
1. The commission of 10% of the total cost of the shiprepair is collected for arranging such repair. Minimum charge is USD36.00
2. When the agent is requested by Master to arrange the attendance of register surveyors, dock yard or specialists in navigational equipment, etc. The charge of USD 36.00 for arranging each attendance is collected. The charge of USD 18.00 per hour collected for the agent’s work with the surveyor or the specialist.
3. The charge of 25% of the relevant rate of Agency Fee will apply for arranging the delivery or redelivery of a time-chartered vessel, the drawing up and the translation of all necessary documents included.
4. The rate of 50% of the relevant Agency Fee is payable for arranging the fumigation of cargo.
5. The transportation of crewmembers, their meals and residence at hotel will be charged at actual costs.
6. The charge of USD 18.00 per visit for each person is collected for arranging the attendance of medical institutions as well as interpreting services rendered.
The following charges are collected for the services rendered to the crewmembers remaining at the hospitals, for each person:

The charge of USD 5.40 per person is collected for arranging vaccination of the crewmembers.
7. The charge of USD 126.00 per person is collected for arranging the repatriation of the crewmembers, arranging visas, booking tickets and hotel accommodation, other services included.
8. In the case of violation of the law by crewmembers the charge of USD36.00 per hour is collected for Agent’s services, including the search, delivery and participation in investigation of the case.
9. Bank charges and petty expenses are collected as follows:

10. Agent’s telephone, cable and telex expenses are to be reimbursed with a 50% surcharge.
11. When the ship owner failed to advance the necessary funds to cover the disbursement expenses of the ship prior to her departure from the port a 5% commission will be assessed on the total sum of the credit granted by Agents.
